Terms and Conditions

These Terms and Conditions govern access to and use of the SmartDriver mobile application (the "App") and this website (together, the "Service"), provided by Fernando Manuel Gomes Aleixo Dorotea, a sole trader, Portuguese tax ID (NIF) 166705667 ("we", "the Provider").

By creating an account, activating an access code, or using the Service, you accept these Terms. If you do not agree, you should not use the Service.

1. What SmartDriver is

SmartDriver is a decision-support application for drivers on passenger transport platforms. The App reads the offer shown on the driver's screen and displays a visual indicator (the "traffic light") with the estimated value per kilometre and per hour, helping the driver decide whether to accept the ride. The decision to accept or decline any offer always rests solely with the driver.

2. Accuracy of information

Offers are read using automatic text recognition on the device's screen. Although the accuracy rate is high, we do not guarantee that the reading will always be exact or complete. SmartDriver is a support tool and does not replace the driver's own verification of the values shown in the transport platform's app before accepting any offer.

3. Account and access licence

• Access is activated through a code linked to a plan (1, 3 or 12 months).
• The licence is intended to be used on a single device at a time. Signing in on a new device activates access on that device, and access on previous devices may be suspended.
• The user is responsible for keeping their access credentials confidential.
• Plans do not auto-renew: access ends at the end of the contracted period unless reactivated.

4. Payments

Plans are paid in advance inside the app, using the payment methods available at the time of subscription, namely MB WAY and Multibanco. Prices shown include applicable taxes unless stated otherwise. Refunds are not issued for access periods already elapsed, except where required by law.

5. Acceptable use

The user agrees not to use the Service for unlawful purposes, not to attempt to circumvent the licensing mechanisms, and not to share their access with third parties in a way that breaches section 3.

6. Limitation of liability

SmartDriver is provided "as is". To the maximum extent permitted by law, we are not liable for decisions made by the driver based on information shown by the App, nor for losses resulting from Service unavailability, reading failures, or incompatibilities with updates to the transport platforms.

7. Changes

We may change these Terms at any time. Material changes will be communicated through the App or this website. Continued use of the Service after a change constitutes acceptance of the new Terms.
